Step By Step Procedure

Terms and Conditions

1. Demand Letter

The First Party shall issue a Demand Letter to the Second Party specifying the number of workers required, salary rates, and other services.

2. Government Approvals

Both parties must obtain government approvals for the import, recruitment, and supply of workers as per the rules of both countries. If there is any conflict between government rules and contract conditions, this agreement shall be deemed null and void.

3. Visa and Documentation

The First Party will provide the necessary Visa/NOC work permits and relevant documents. If visas are not issued due to changes in government policies, the First Party will bear the recruitment expenses.

4. Worker Earnings

Earnings per worker per month will be as per the attached Demand Letter for each category.

5. Medical Examination

The Second Party must ensure that all recommended workers are examined and possess valid health certificates, including tests for AIDS, T.B., and other infections. Original medical certificates and passport copies must be submitted.

6. Airport Reception

The First Party is responsible for receiving the workers at the airport.

7. Recruitment Responsibility

The Second Party will handle the recruitment of workers from Nepal, adhering to specified trades, and ensure recruitment within 45 days of receiving visa advice and documents.

8. Compensation

The First Party agrees to bear compensation for worker death or injury, including the cost of transporting the deceased's body to Nepal, as per the labor laws of the concerned country.

9. Probationary Period

Workers will have a three-month probationary period. If found unfit or unsuitable after this period, they may be terminated and repatriated at their own cost, borne by the Second Party.

10. Worker Interviews and Testing

The workers will be interviewed and tested by the employer's representative.

11. Immigration and Medical Assistance

The Second Party will assist workers with immigration formalities, medical tests, and visa stamping from relevant embassies.

12. Accommodation and Amenities

The First Party will provide free bachelor-sharing accommodation, food, and necessary amenities, including medical and insurance coverage.

13. Manpower Agreement

The First Party agrees to enter into an agreement with the Second Party to supply Nepalese manpower, specifying the number and qualifications required through task orders.

14. Personnel Requirements

The First Party will advise the Second Party of its personnel requirements via cable, telex, or letter, detailing job descriptions, salaries, terms, and desired mobilization dates.

15. Candidate Selection

The Second Party will shortlist candidates based on the First Party's requirements and notify the First Party for final interview and selection. The Second Party guarantees the selection and processing of qualified workers.

16. Agency Fees

The First Party shall not pay recruitment fees. The Second Party will pay for PTA Air Tickets for candidates repatriated before the three-month probation period. The First Party will cover air tickets for repatriation after the original two-year contract.
